“Arion Labs” is the trading name under which the Seller presents itself to customers in operating the online store. The contracting party and holder of all rights and obligations under these Terms is always the Seller, i.e. index rozvoje s.r.o. Any reference to “Arion Labs”, the “store” or the “online store” refers to the Seller in this sense.
These General Terms and Conditions of Sale (the “Terms”) govern the mutual rights and obligations of the parties arising from sales contracts concluded between the Seller and any natural or legal person (the “Customer”) through the online store. Where the sale is made to consumers habitually resident in Spain, the mandatory provisions of Spanish consumer law apply in addition, pursuant to Article 6 of Regulation (EC) No 593/2008 (Rome I), to the extent they are more favourable to the consumer than Czech law.
1.1 These Terms apply both to Customers who qualify as consumers and users within the meaning of Article 3 of the recast text of the General Law for the Protection of Consumers and Users (Royal Legislative Decree 1/2007, “TRLGDCU”), and to Customers acting within their business or professional activity. Stipulations expressly reserved for consumers do not apply to professionals.
1.2 Particular stipulations agreed in the sales contract take precedence over these Terms.
1.3 The Seller may amend or supplement these Terms. The version in force at the time an order is placed applies to that contract.
2.1 The Seller offers, through the online store, chemical substances, peptides and related products (the “Products”), intended exclusively for scientific, experimental and laboratory purposes (“research use only”). The Products are intended for in-vitro use or other laboratory and analytical purposes, exclusively by qualified persons in an appropriate laboratory or research setting.
2.2 The Products offered by the Seller are not medicinal products within the meaning of Royal Legislative Decree 1/2015, approving the recast text of the Law on Guarantees and Rational Use of Medicinal Products and Medical Devices; not foodstuffs or food supplements within the meaning of Royal Decree 1487/2009; not cosmetic products within the meaning of Regulation (EC) No 1223/2009; and not veterinary medicinal products. The Products are not intended for human or animal consumption, application on or into the human or animal body, or any similar use.
2.3 The Products are intended exclusively for persons or entities competent to handle chemical substances professionally (research centres, laboratories, universities, corporate development departments, etc.) and may only be used in accordance with their stated purpose and applicable chemicals and occupational-safety legislation, in particular Regulation (EC) No 1907/2006 (REACH) and Regulation (EC) No 1272/2008 (CLP).
2.4 The Products are reserved for adults with full legal capacity to act. By placing an order, the Customer declares that this condition is met.
2.5 The Seller reserves the right to refuse an order or terminate the contract if there is a reasonable suspicion that the Customer intends to use the Product contrary to its stated purpose under this article, or that the conditions of paragraphs 2.3 and 2.4 are not met.
3.1 The order process includes the active confirmation (tick box) of the following declaration, without which the order cannot be finalised:
“I declare that I will use the purchased Product (chemical substances/peptides) exclusively for research and/or laboratory purposes, and not otherwise, in particular not for human or animal consumption, application on or into the body, or for therapeutic, dietary, cosmetic, doping or other purposes. I declare that I am able to handle the Product in compliance with the law in force in the Kingdom of Spain and the European Union, and that I will act in accordance with these Terms. I acknowledge that, by placing this order and giving this consent, full responsibility relating to the subsequent handling of the Product and its use is transferred to me.”
3.2 By placing an order and confirming the declaration in paragraph 3.1, the Customer expressly confirms and undertakes to use the Product exclusively for research/laboratory purposes; to be aware that the Product is not intended for human/animal consumption or application; to handle the Product in accordance with applicable regulations (in particular occupational-safety and chemicals legislation); to independently verify the particular legal status of any given substance (e.g. anti-doping regulations); and not to transfer the Product to third parties in a manner that could result in use contrary to its stated purpose.
3.3 Upon conclusion of the sales contract, responsibility for the subsequent handling of the purchased Product is transferred to the Customer, in particular as regards the choice of manner and purpose of use, the conformity of such use with the law applicable at the place of use, and any personal injury or material damage suffered by the Customer, third parties, or the Seller as a result of a use of the Product contrary to its stated purpose under these Terms or contrary to applicable regulations.
3.4 The Seller shall not be liable for damage arising from a use of the Product contrary to its stated purpose under these Terms. This stipulation does not affect the Seller's liability for defects in the Product (Article 7), or its liability for wilful misconduct or gross negligence, or for damage to life, physical integrity or health, which cannot be excluded or limited pursuant to Article 1102 of the Civil Code and Article 86 of the TRLGDCU.
4.1 The presentation of Products on the online store is purely informative and does not constitute a binding offer by the Seller, but an invitation to contract.
4.2 An order placed by the Customer by clicking the order button constitutes an offer to purchase. The contract is deemed concluded when the Customer receives the order confirmation sent by the Seller to the e-mail address provided.
4.3 All prices shown on the online store are inclusive of taxes; shipping costs will be indicated separately before the order is finalised.
5.1 Payment shall be made by bank transfer or by cash on delivery upon receipt of the shipment. The payment methods available for the given delivery country and shipping method are shown in the online store when completing the order.
5.2 The Product will be shipped within the period indicated on the product page, unless otherwise agreed. Due to the nature of the Product, shipment is made in neutral packaging, without indication of contents.
6.1 In accordance with Articles 102 et seq. of the TRLGDCU, the consumer shall have a period of 14 calendar days to withdraw from a contract concluded at a distance without the need for justification. The period shall be computed from receipt of the goods by the consumer or by a third party indicated by the consumer, other than the carrier.
6.2 To exercise the right of withdrawal, the consumer must notify their decision by means of an unequivocal statement (e-mail to info@arionpeptides.com, letter, or the model form set out in Annex B to the TRLGDCU, the use of which is not mandatory). It is sufficient for the communication to be sent before the corresponding period expires. Withdrawal may also be exercised via the electronic withdrawal function made available on the Seller's website.
6.3 The Seller shall reimburse all payments received from the consumer, including delivery costs, without undue delay and in any event within 14 calendar days from the date on which it is informed of the decision to withdraw, in accordance with Article 107 of the TRLGDCU.
6.4 In accordance with Article 103 of the TRLGDCU, the right of withdrawal does not apply to contracts for the supply of sealed goods which are not suitable for return for health-protection or hygiene reasons and which have been unsealed after delivery; the Seller shall indicate this exception on the relevant product page where applicable.
7.1 The Seller is liable for any lack of conformity of the Products in accordance with Articles 114 et seq. of the TRLGDCU.
7.2 This guarantee does not cover defects arising from a use of the Product contrary to its stated purpose under Article 2, improper storage by the Customer after delivery, or expiry of the recommended shelf life.
8.1 The Seller processes the Customer's personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights. Details are set out in the Privacy Policy available on the website.
9.1 The consumer may refer a dispute to the Consumer Arbitration Boards (arbitraje de consumo) regulated by Royal Decree 231/2008, provided the Seller is adhered to that system, or to the European online dispute resolution platform available at ec.europa.eu/consumers/odr. The consumer may also contact the regional consumer authorities or consumer organisations for advice.
10.1 Relations between the Seller and the Customer are governed by Czech law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Where the Customer is a consumer habitually resident in Spain, this choice of law shall not deprive the consumer of the protection afforded by the mandatory provisions of Spanish law, in accordance with Article 6(2) of the Rome I Regulation.
10.2 Should any stipulation of these Terms prove null or ineffective, this shall not affect the validity of the remaining stipulations.
These Terms take effect on 08/09/2026.
